Welcome to CADR, a brand of Cadration Foundation. These Terms & Conditions (“Terms”) govern your access to and use of the CADR website, arbitration administration services, and related resources (“Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services. “You” refers to users of the Services, including parties, representatives, arbitrators, and website visitors.  

 

1. Definitions

 

  • "Institution" refers to the Centre for Arbitration and Dispute Resolution (CADR), the arbitration institution administering domestic arbitration in accordance with its Rules.

  • "User" refers to any individual or entity using the CADR website or services, including parties to arbitration, arbitrators, counsel, and other stakeholders visiting or using the website or services.

  • "Services" mean arbitration administration, online filings, scheduling, communication, and other support functions provided by CADR.

 

2. Acceptance of Terms

By using this website or registering for arbitration services, you:

  • Confirm you are competent to contract under Indian law;

  • Agree to comply with all applicable laws, rules, and regulations;

  • Agree to be bound by these Terms, the Privacy Policy, and any institutional guidelines or Practice Notes issued by the Institution.

 

3. Description of Services 

 

CADR provides administrative support for domestic arbitration proceedings conducted under the CADR Domestic Arbitration Rules, 2025 ("Rules"). Our role includes facilitating the appointment of tribunals, managing communications, handling fee deposits, and providing procedural guidance according to the Rules. The Institution does not act as an arbitrator or decide the merits of any dispute.   

 

4. Use of Services & User Responsibilities

 

  • You agree to use the Services only for lawful purposes and in accordance with these Terms and the applicable CADR Rules.   

  • You are responsible for providing accurate, complete, and current information required for the administration of arbitration proceedings (e.g., contact details, case information).   

  • Parties are responsible for the timely payment of applicable registration fees, administrative fees, and arbitrator fees as determined by the Institution according to its schedule and the Rules.   

  • You agree to cooperate with the Institution and the Arbitral Tribunal and act in good faith throughout the process.   

  • You agree to maintain the confidentiality of your login credentials

  • You agree to not misuse or tamper with the portal’s integrity or security

  • You agree to not upload malicious files or disruptive code

  • You agree to not impersonate any other individual or entity

  • You shall respect the confidentiality of the arbitration proceedings as outlined in the Rules.

 

The Institution reserves the right to suspend or terminate your access if you violate these Terms or engage in unlawful or disruptive conduct. 

 

5. Intellectual Property 

 

  • All content on the Institution’s website, including text, graphics, logos, documents and software, is the property of the Institution or its licensors and is protected by copyright and other intellectual property laws. 

  • You may access and use the content for informational purposes related to our Services, but may not reproduce, distribute, modify, or create derivative works without our express written permission.   

 

6. Warranties 

 

  • The Services are provided on an "as is" and "as available" basis. The Institution makes no warranties, express or implied, regarding the completeness, accuracy, reliability, suitability, or availability of the Services or the information contained therein.   

  • The Institution provides administrative services only. We are not liable for the conduct or decisions of any arbitral tribunal appointed under our Rules. The responsibility for resolving the dispute rests solely with the arbitral tribunal.   

  • While we strive for efficient administration, we are not liable for any delays caused by factors beyond our reasonable control, including the actions or omissions of parties or arbitrators, or court interventions.   

 

7. Limitation of Liability

To the fullest extent permitted by law, the Institution, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: 

​

  • your access to or use of or inability to access or use the Services; 

  • any conduct or content of any third party (including arbitrators or other parties); 

  • any content obtained from the Services; or 

  • unauthorised access, use, or alteration of your transmissions or content. 

 

The liability of the Institution in connection with the administration of any arbitration shall be limited to the amount of administrative fees paid to the Institution for that specific arbitration.   

 

8. Confidentiality

Information submitted to the Institution for the purpose of arbitration proceedings will be handled in accordance with the confidentiality provisions of the Institution’s Rules and our Privacy Policy.   

 

9. Data Protection and Privacy

​

Your personal data is processed in accordance with our Privacy Policy, which complies with the Digital Personal Data Protection Act, 2023. By using our services, you consent to such processing and represent that all data provided by you is accurate.

10. Suspension and Termination

 

The Institution may suspend or terminate your access without notice:

  • If you breach these Terms or applicable laws;

  • If your conduct threatens the security or integrity of the platform;

  • As required by judicial or regulatory authorities.

 

11. Governing Law and Dispute Resolution 

​

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the administrative services provided by the Institution (not related to the merits of an arbitrated dispute) shall be subject to the exclusive jurisdiction of the courts in Delhi, India.  

 

12. Amendments 

The Institution reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
